CHOOSING THE BEST CRIMINAL LAWYER FOR YOUR CASE


 

Choosing a criminal lawyer can be a difficult process.  There are countless lawyers who advertise that they provide legal services to those who have been charged with criminal offences.  The process of deciding on the best criminal lawyer to hire can be confusing and stressful; it is one of the most important decisions you will have to make in your life as your liberty and criminal record are at stake.  

The following are some do's and don'ts for hiring a criminal lawyer:

DO:
Hire someone who restricts their practice to criminal law.

DON'T:
Hire a lawyer who lists criminal law as one of numerous practice areas.  Think of it this way, you wouldn't hire a dentist to perform your open heart surgery.

DO:
Hire a lawyer who has successfully defended your kind of charges in the past.

DON'T:
Hire a lawyer who has no experience with your type of case.

DO:
Hire a lawyer who has a proven track record of both winning cases at trial and getting charges withdrawn without the need for trial.

DON'T:
Hire a lawyer who can only list guilty pleas and withdrawn charges as their greatest accomplishments.  You need someone who can take your case to trial and win using all factual, legal, constitutional and technical defences available.

DO:
Take your time and meet with your prospective lawyer at his office to make sure you feel comfortable with him and that he strikes you as competent and professional. 

DON'T:
Hire a lawyer who solicits your business in the hallway of the courthouse or conducts meetings at Tim Hortons.     

DO:
Hire a lawyer who speaks of other lawyers with respect and courtesy.

DON'T:
Hire a lawyer who speaks negatively of their competition.  Not only is this a sign of insecurity, it is contrary to the Rules of Professional Conduct of the Law Society of Upper Canada.

DO:
Ask your prospective lawyer whether he will be the one providing your legal services from start to finish.

DON'T:
Hire a lawyer and later find out that he passes off all his trial matters to junior counsel from his office.  Unfortunately this practice is all too common.  Get an assurance that your lawyer will remain your lawyer from start to finish of your case.
